The Bylaws for Balmoral Improvement Association, Inc., recorded in the Carroll County Registry of Deeds in the State of New Hampshire. Book 3147, Page 538, are hereby amended and restated in their entirety, a true copy of which follow and have been approved by the membership and Directors at a duly called annual meeting dated May 24, 2014.

Article VII - Restrictions and Limitations of all Said Real Property

Section IX

Only registered Motor Vehicles and Snowmobiles are permitted for use on Balmoral Properties as regulated by all local, state, and federal laws.

Golf Carts are also permitted for use only if they are standard, non-modified golf carts, acceptable for use on a sanctioned golf course and as regulated by any local, state and federal laws. They can only be operated from sunrise to sunset unless properly equipped with operational headlights and taillights. The number of occupants may not exceed those specified by the manufacturer. No standing or hanging from the golf cart or towing of other objects or people is permitted. Golf carts may only be operated by a driver with a duly issued motor vehicle operator’s license.

All Golf Carts must have proof of insurance.Pocket Rockets, Go-carts, homemade motor vehicles, and all other motorized vehicles not registered are prohibited on Balmoral Property.

In addition, below are rules governing operation of golf carts on BIA property:



RULES GOVERNING OPERATION OF A GOLF CART


  1. Golf carts may only be operated by a driver with a duly issued motor vehicle operator’s license.
  2. Golf carts may only be operated from sunrise to sunset unless properly equipped with operational headlights and tail lights.  Golf cart must be a standard unmodified golf cart acceptable for use on a sanctioned golf course and as regulated by any local state or federal laws.
  3. Drivers need to be fully aware of the many safety risks to children while operating golf carts. Infants and small children are especially at risk and should be secured AT ALL TIMES by another golf cart passenger age 16 or older. The driver may not hold a child or infant while operating a cart.  Please note that in general MOST golf cart manufacturers do not recommend the use of seat belts or traditional car seats for children and infants. 
  4. No standing or hanging from the golf cart shall be permitted.
  5. Towing of objects by a golf cart is not permitted.
  6. Reckless driving or speeding above posted speeds is not permitted.
  7. All golf carts must be registered with the Balmoral Board of Directors.  Upon proof of liability insurance, a number will be assigned and decals issued.  The decals should be affixed to the front left and right fenders.  No other numbers other than those assigned to the golf cart by the Balmoral Board of Directors may be displayed. 
  8. Failure to comply with the regulations regarding golf carts may result in the following action from the Board of Directors:


  • First Offense:        Written warning


  • Second Offense:   $150 fine


  • Third Offense:      $500 fine.  Additionally, based on severity of the violation and/or continued problematic issues by said cart or its users, we reserve the right to suspend the operator and/or golf cart for the remainder of season. 


Fines that remain unpaid after 30 days will accrue interest at 12%.  The Board may enforce collection of any fines by taking all steps in its power, including, but not limited to filing a lien against the property owner and commencing collection proceedings.
